Submitting a Bankruptcy Package Electronically (eSR)

This website and its ability to assist in the electronic submission of a bankruptcy package have been developed to provide information to you if you are an individual and are considering filing for bankruptcy by yourself or with your spouse and without an attorney. Do not use this package if you are preparing a bankruptcy petition on behalf of a non-individual, such as a corporation, partnership or a limited liability company (LLC).

Please note that the electronic submission of a bankruptcy package in the Eastern District of Pennsylvania is currently only available for Chapter 7 cases and is not available to attorneys or bankruptcy petition preparers.

 
IMPORTANT WARNING Because bankruptcy can have serious long-term financial and legal consequences, including loss of your property, you should hire a lawyer and carefully consider all of your options before you file. A lawyer can explain to you what can happen as a result of filing for bankruptcy and what your options are. If you do file for bankruptcy, a lawyer can help protect you, your family, your home and your possessions.

 

Although the law allows you to represent yourself in bankruptcy court, you should understand that many people find it extremely difficult to represent themselves successfully. The rules are very technical, and a misstep or inaction may affect your rights. If you file without a lawyer, you are still responsible for knowing and following all of the legal requirements.

Bankruptcy fraud is a serious crime; you could be fined and imprisoned if you commit fraud in your bankruptcy case. If you make a false statement, you could be fined up to $500,000 or imprisoned for up to 5 years or both. 18 USC sections 152 and 3571.

IMPORTANT INFORMATION CONCERNING FORECLOSURE:

Homeowners who are having trouble or have fallen behind in making their mortgage payments may have options that would allow them to avoid foreclosure and bankruptcy. If you are filing bankruptcy to delay or stop a foreclosure action on your home, it is very important for you to understand that the “Electronic Submission of a Bankruptcy Package” may delay the filing of your case for several days until the court receives the additional items required to complete your filing.
