Introduction
Unclaimed funds are funds held by the court for an owner or recipient entitled to a distribution from a bankruptcy case, but who has not claimed ownership. Most unclaimed funds are deposited with the court when claimants’ checks are returned to the case trustee as undeliverable.
Unclaimed funds may arise out of a variety of circumstances in bankruptcy cases, such as:
- Incorrect address for the recipient.
- Un-cashed distribution checks.
- Death of intended recipient.
Unclaimed funds may be claimed at any time by an owner, successor, or other claimant who proves a right to the funds.

How to Make a Claim of an Unclaimed Fund held by this Court
To claim any funds held by the U.S. Bankruptcy Court for the Eastern District of Pennsylvania, file an application with supporting documentation and providing proof of identity using Form 1340 below:

Note: Local Bankruptcy Rule 3011-1 requires a Motion for the Withdrawal of Unclaimed funds to be filed with the Court. Only an order signed by a judge can release these funds.
