NOTICE TO THE BAR RE: CIVIL FILING FEES



The Judicial Conference has approved an increase, effective February 7, 2005, in the fee for filing a civil action under 28 U.S.C. § 1914(a) from $150.00 to $250.00. Under the Bankruptcy Miscellaneous Fee Schedule (28 U.S.C. § 1930), the fee for filing an adversary complaint and the fee for filing a motion to lift the automatic stay are linked to the civil filing fee.

Please take notice that the fee for filing an adversary proceeding will remain at $150.00 until further notice. However, the language in Item 6 of the Bankruptcy Miscellaneous Fee Schedule will continue to reference the amount required for the civil filing fee. The fee for filing a motion to lift the automatic stay will remain at $150.00. Item 20 of the Bankruptcy Miscellaneous Fee Schedule has been amended to delete the language linking the fee for filing a motion to lift the automatic stay to the amount required for filing a civil action under § 1914.
