Means Testing Information

The “means test” is used to determine whether or not a debtor is entitled to file a case under chapter 7 or whether such debtor must convert the case to another chapter of the Bankruptcy Code. Generally, under the means test, the court compares the debtor’s monthly income and expenses in order to determine whether or not granting a chapter 7 discharge would constitute an “abuse” of the Bankruptcy Code.  All chapter 7 debtors must complete the  Means Test Forms  (Official Form 122A-1 and 122 A-1 Supp).
